1. Definitions

  • • "Service" refers to all the services provided by Ibn taymiyyah, including website development, app design, digital marketing, and support/maintenance services.
  • • "Client" refers to any person or entity requesting services from Ibn taymiyyah.
  • • "Initial Payment" refers to the amount paid by the client at the beginning of the project.

2. Payment Terms

  • • The client is required to make an Initial Payment before any work begins on the project, which shall be 50% of the total project cost. This payment will be considered part of the total project cost.
  • • If the payment is made via bank transfer, the transfer will serve as a legal proof document confirming the client’s acceptance of these terms and conditions.

3. Project Cancellation

  • • If the client decides to cancel the project after work has commenced, the client agrees that the paid amount is non-refundable.
  • • A portion of the paid amount will be deducted to cover the costs incurred during the project, including work done or materials created up to the point of cancellation.
  • • The deducted amount will be based on the scope of work completed and the estimated time and resources allocated to the project.

4. Modifications and Additional Requests

  • • Any modifications or additional requests after the submission of initial drafts or the completion of preliminary work will be charged as additional services and added to the project cost.
  • Ibn taymiyyah reserves the right to determine whether the requested modifications are substantial or minor. If they are substantial, additional fees may apply, or the project timeline may be extended.

5. Ownership and Usage Rights

  • • Once the client has paid the full amount for the project, all intellectual property rights to the completed work (such as designs, code, applications, etc.) will transfer to the client. However, Ibn taymiyyah reserves the right to use the developed solutions for other projects, while maintaining the confidentiality of any sensitive information.
  • Ibn taymiyyah retains the right to use the work completed for promotional purposes, such as displaying it in the portfolio, case studies on the website, or marketing campaigns.

6. Digital Marketing and Publishing

  • • The client agrees that once the project is completed and delivered, Ibn taymiyyah may use the project for marketing purposes, such as promoting the website or application through newsletters, advertisements, or social media.

7. Confidentiality and Data Protection

  • Ibn taymiyyah is committed to maintaining the confidentiality of the information provided by the client and will only use it to execute the project.
  • • The client agrees that, in the event of any leak of confidential information related to the company or the project due to negligence or error on their part or third parties (such as external service providers), the company will not be held responsible.

8. Temporary Suspension or Termination of Service

  • Ibn taymiyyah reserves the right to suspend or terminate the service if any of the terms of service are violated or if the client fails to meet their financial or legal obligations.
  • • In the event of termination, the client is entitled to receive a copy of the work completed up to that point, with costs deducted for the work that has already been performed.

9. Indemnity

  • • The client agrees to indemnify Ibn taymiyyah against any damages, losses, or costs arising from the client’s use of the services or due to their violation of these terms.
  • • This includes damages caused by illegal use or violation of the intellectual property rights of Ibn taymiyyah or any third party.

10. Amendments to the Terms

  • Ibn taymiyyah reserves the right to amend these terms at any time. Clients will be notified of any significant changes via email or by updating the terms on the website.

11. Project Completion and Delivery

  • Ibn taymiyyah does not guarantee any specific delivery dates unless explicitly agreed upon in advance. Delivery deadlines depend on receiving all required information from the client in a timely manner.
  • • If the client delays in providing necessary approvals or materials required to complete the project, Ibn taymiyyah reserves the right to adjust the schedule and extend the delivery time.

12. Intellectual Property

  • • All rights related to designs, code, applications, or any other materials created during the project will not be transferred to the client until Ibn taymiyyah has received the full payment due from the client.

13. Communication

  • • If there are any inquiries or issues related to these terms, the client can contact Ibn taymiyyah via email or phone, and a response will be provided as soon as possible.

Client’s Acknowledgment

By making the Initial Payment, the client confirms that they have read, understood, and agreed to these Terms of Service. The payment will be regarded as confirmation of the client’s acceptance of these terms.
